These Terms and Conditions define the rules for using the online platform agent001.ai, hereinafter referred to as the “Platform”.
The operator of the Platform is Okinet s.c., Sucha 3, 50-086 Wrocław, Poland, VAT Number: PL8971857865 hereinafter referred to as the “Operator”.
The Platform is intended exclusively for businesses, entrepreneurs, organizations, and entities conducting commercial or professional activities.
Use of the Platform by consumers within the meaning of applicable consumer protection laws is not permitted.
By registering an account or using the Platform, the User declares that they act as a business entity or on behalf of a business entity.
The Platform enables the use of artificial intelligence tools, including chatbots, AI agents, language models, automations, integrations with external systems, and other AI-supported functionalities.
Using the Platform constitutes acceptance of these Terms and Conditions.
§2. Definitions
Platform – the online application agent001.ai combining chatbot functionalities, AI agents, automation tools, and integrations with external systems.
User – a business entity, entrepreneur, organization, or other entity using the Platform in connection with commercial or professional activities.
End User – a person using functionalities made available by the User or the Operator through the Platform.
LLM – external artificial intelligence language models, including Large Language Models used for generating responses and content.
Integrations – connections with external systems through APIs, plugins, extensions, access tokens, third-party accounts, or other authorization mechanisms.
§3. Scope of Services
The Platform enables generation of responses, analyses, summaries, recommendations, automations, and other content using artificial intelligence technologies.
The Platform may communicate with external AI models and systems to which the User has granted access.
The Operator does not guarantee the correctness, completeness, accuracy, reliability, availability, or usefulness of any content generated by the Platform.
All AI-generated responses and outputs are provided solely for informational and supportive purposes.
The Platform does not provide legal, medical, financial, accounting, tax, psychological, compliance, or other licensed professional services.
§4. Nature of Artificial Intelligence Services
The User acknowledges that AI-generated responses may be inaccurate, incomplete, outdated, misleading, inappropriate, or inconsistent with the User’s expectations.
Content generated by the Platform shall not be considered professional advice, expert opinion, or legally binding information.
The User is solely responsible for independently verifying all information generated by the Platform before making decisions or taking actions.
Any decisions made based on Platform-generated content are made solely at the User’s own risk and responsibility.
§5. Data, Instructions, and Integrations
The Operator does not permanently collect, archive, or store content entered by End Users unless necessary for Platform functionality, security, technical support, legal obligations, or fraud prevention.
The User acknowledges that prompts, instructions, requests, commands, messages, and other content submitted to the Platform may be transmitted to external AI providers and LLM systems for processing and response generation.
Data sent to external AI models may be processed in accordance with the terms, privacy policies, and security standards of such third-party providers.
The Platform may collect and process:
content entered into chats, forms, and prompts,
AI agent instructions and configurations,
data transmitted through integrations,
data retrieved from external systems to which access has been granted,
technical and operational data necessary for Platform functionality.
The User may grant the Platform access to external systems through APIs, plugins, integrations, access tokens, third-party accounts, or other authorization mechanisms.
Data retrieved from external systems may be processed solely for the purpose of executing User instructions, enabling Platform functionalities, and generating AI responses.
The User bears full responsibility for the scope of permissions, data, instructions, and access granted to the Platform.
The User represents and warrants that they possess all required rights, permissions, and legal bases necessary to share data with the Platform and authorize access to external systems.
§6. User Responsibilities
The User uses the Platform entirely at their own risk.
The User agrees to use the Platform in compliance with applicable laws, regulations, and these Terms and Conditions.
The User is prohibited from using the Platform for:
illegal or unlawful activities,
creating unlawful, abusive, discriminatory, harmful, or misleading content,
violating intellectual property rights or rights of third parties,
unauthorized processing of personal data,
attempts to bypass security measures,
interfering with the operation of the Platform or third-party systems.
The User remains solely responsible for all data, instructions, prompts, and content submitted to the Platform.
§7. Limitation of Liability
The Operator makes reasonable efforts to ensure proper operation of the Platform but shall not be liable for consequences resulting from the use of AI-generated content.
The Operator shall not be liable for:
errors or inaccuracies in generated responses,
incorrect, incomplete, or outdated information,
business or personal decisions made based on Platform outputs,
direct, indirect, incidental, or consequential damages,
loss of data, interruptions, downtime, or service unavailability,
actions or failures of external AI, API, plugin, hosting, or integration providers,
consequences of granting access to external systems,
use of generated content by the User or third parties.
The Operator does not guarantee uninterrupted, error-free, secure, or expectation-compliant operation of the Platform.
The Operator shall not be responsible for processing of data by third-party AI providers or integrated external systems.
To the maximum extent permitted by law, the total liability of the Operator shall be limited to the amount paid by the User for the Platform during the thirty (30) days preceding the claim.
The parties expressly exclude the application of consumer protection regulations to the extent permitted under applicable law.
§8. Confidentiality and Security
The User should not submit confidential information, trade secrets, sensitive data, or personal data without appropriate legal authorization.
The User acknowledges that use of the Platform may involve processing of data by external service providers necessary for operation of the Platform.
The Operator applies reasonable technical and organizational measures intended to secure the Platform but cannot guarantee complete security of data transmitted over the Internet.
§9. Intellectual Property
All rights related to the Platform, including source code, software, branding, visual design, architecture, and functionalities belong to the Operator or relevant licensors.
The User is solely responsible for the use of content generated by the Platform.
The Operator does not guarantee that generated content will be unique or free from similarities to existing materials.
The User is responsible for independently verifying whether generated content may be lawfully used for commercial, professional, or public purposes.
§10. Availability of the Platform
The Operator reserves the right to temporarily suspend, restrict, modify, or discontinue operation of the Platform.
Interruptions may result from maintenance, updates, technical failures, third-party provider issues, cybersecurity incidents, or force majeure events.
The Operator may modify, expand, limit, or remove functionalities of the Platform at any time without prior notice.
§11. Suspension or Termination of Access
The Operator may suspend or terminate access to the Platform if the User violates these Terms and Conditions, applicable laws, or security policies.
The Operator may refuse service in cases of suspected abuse, unlawful activity, excessive system load, security risks, or actions harmful to the Platform, Operator, Users, or third parties.
§12. Amendments to the Terms
The Operator reserves the right to amend these Terms and Conditions at any time.
Changes become effective upon publication on the Platform unless stated otherwise.
Continued use of the Platform after publication of changes constitutes acceptance of the updated Terms and Conditions.
§13. Final Provisions
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Poland.
Any disputes arising from use of the Platform shall be resolved by the competent court having jurisdiction over the Operator’s registered office, unless mandatory law provides otherwise.
If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions enter into force on the date of publication on the Platform.
